Be careful what you tweet

Twitter is hugely popular as we all know, but be careful what you tweet...

Courtney Love is being sued for libel by a fashion designer who she posted derogatory comments about on her twitter. They supposedly had a disagreement over Love paying Dawn Simorangkir for clothes she designed so Love posted less than favorable words about the designer (including posting that the Simorangkir had a history of dealing cocaine). The Los Angeles Superior Court would not dismiss the case.

It seems that tweets may not be considered free speech even for non-celebs. A woman is being sued by her former landlord for tweeting that his company thinks it's okay to sleep in a moldy apartment. The tweet did get the attention of her landlord, but probably not in the way she intented - they sued her for libel and are asking for 50K.

A simplistic definition of libel is a "false and malicious publication printed for the purpose of defaming a living person."

But legal experts are dealing with uncharted territory with libel as it pertains to social media. Will a defamatory tweet be treated the same as a derogatory and untrue remark in a printed magazine?

I wonder how the line will be drawn between free speech and libel...

    Unfortunately people think our freedoms are absolute... however, our freedoms stop where the next persons starts and online there is no exceptions.

    Apparently anything documented can & will be used in a court of law.

    I am happy about this, you know its funny how things will be said and sometimes it is not true, its not fair and she should have to pay for saying innapropiate things just because she decided to not pay for the clothes that were being provided to her.

    yeah freedom isnt absolute but exceptioons do exist...life if a qualified privilege applies in her case.

    Most of the time tweeting is for twits. Its just another "Look at what I'm doing to make me appear more important and opinionated than you fad". Its only relevance was explicated during Iran's election protests, where freedom of speech was pretty much non-existent if not censored altogether.
