Degrees of Criminal Charges Involving Killing

There are varying degrees of criminal charges that can be put against you in the event that you kill someone. These different degrees can range from murder in the first degree down to manslaughter. If you are being charged with killing someone, it is important to know the differences between these different levels of killing, and the penalties that accompany them.

The most serious and harshly penalized form of killing another person is murder in the first degree. This is a premeditated killing that involves a state of mind known as malice. Malice is very basically defined as intent to kill.

The necessary aspects of the crime that make it first degree murder are premeditation and the state of mind of the killer. If one of these two things is missing, the crime cannot be considered murder in the first degree. However, it is possible to be charged with first degree murder without killing another person. If there are multiple people committing a felony and one of them dies, the others can be charged with murder in the first degree. This is an exception to the rule aforementioned.

    criminals are human beings too. the might have done mistakes, but they already paid the price for it....

    They r not consider human. Those who practice abortion are people who are coward to face responsibility but brave to commit a sin . They would pay what they have done.

    I'm not for abortions except in very special cases. But nowhere in the bible does it say we are allowed to judge other people, whether it be by killing them or otherwise. Yes, there are degrees used in the justice system to determine what type of punishment when a human life is taken. But, it seems to me that this man knew of this doctor and planned his actions. That would be premeditated which would mean murder 1. A lesser charge in this case is going to be hard to prove. Either way the guy is just as guilty as the abortion doctor. Two wrongs don't make a right, period. As a christian I learned to leave the vengeance to God himself. He will punish accordingly in fitting with the crime. Humans don't always make the right choices about levels of punishments. It often backfires. I just hope that this man who killed the doctor realized that he was wrong too.

    WOW! I believe in capital punishment! I also believe that we should give to God what is Gods and to Caesar what is Caesars! Caesar being the gov, laws of the land, etc. He should have the full punishment of Caesars law. God will judge him when he gets his hands on him.

    I agree, everyone deserves a second chance, and God gives us that, but you are talking about society's rules and laws, the law not always gives second chances, sometimes people get lethal injections, in a perfect world no one would commit crimes or get sentenced to death, but this is not a perfect world, but from a religious point of view, yeah, everyone deserves a second chance.

    My faith tells me I should give everyone a second chance. My brain, however, tells me to agree with shygrneyzs. Its somewhat individual. Are they reformed? Then heck yes! Do they just want another chance to harm? Then, heck no!

    The question of whether rehabilitation or punishment is best way of handling crime requires us to truly analyze societies values. It would make sense to say that punishment should be made relative to the amount of harm the crime causes, or the amount of potential harm the person doing the crime can cause in the future if not incarcerated.
