Think you can't be fired for being a smoker or a frequent bungee jumper? Don't be too sure.

One company chief in Michigan ordered employees to quit smoking in 15 months or lose their jobs, according to a recent article in the San Francisco Chronicle. Such an edict wouldn't fly for a California company due to state laws, but it's an interesting example of employers having more authority over workers' off-the-job activities.

"Most workers in the private sector don't understand that, unless they live in Montana and Arizona, their job is at-will," Paul Secunda, an assistant professor of law at the University of Mississippi, told Yahoo! HotJobs. "At-will means an employee can be fired for good cause or no cause at all," Secunda said.

Besides smoking and overeating, activities with less risk, like blogging or volunteering for a political campaign, can be fair game for termination. You can find some important tips about protecting yourself in this article.

    If your personal habit does not effect your performance at work than it shouldn't be a problem at all. Some people just like to be the "BOSS". It's ok to want the best for your employees but I honestly think that this is not the case. It's up to GOD to save the world not this company. People will change there lifestyle by choice but not by being forced. What are they accomplishing by doing this? Once the person is fired they'll still smoke and still nothing has been accomplished.

    Well, if i had a job that paid me enough money to actually take in to consideration quitting, I would probably do it. Or i would just not smoke at work. But where i work and the pay i get. I would continue smoking for 15 months and then blow it in their face and leave to the next job. So stupid..

    there are a lot of states that do protect against firing for smoking. There is a joint law suit in process just for that reason. Your boss is not your mother and should not have the right to tell you weither or not you can smoke. As long as you only do it on your breaks, it should not be a problem. If you fire someone for smoking you could get sued and rightly so in my opinion. As long as you do a good job it should not be an issue and is discriminatory.

    Who are we kidding? Every smoker I've ever worked with has regularly disappeared for 15-20 minutes and THEN, IN ADDITION, taken the same breaks the rest of us got. At my job, they go down 5 floors to smoke, so are unavailable unexpectedly, to help in an emergency or to DO THEIR OWN JOBS. What about this is an advantage to coworkers, or employers?

    This is ridiculous. It is no ones business as to who smokes or who doesn't. I hope that anyone who gets fired just because they're a smoker (and not because their work was effected by their habit) should sue.

    We smokers are demonized on a regular basis in the name of Public or Personal Health. It's a slippery slope...and incrimentalism will destroy us all.

    An at will employee does not always mean you can fire an employee for not having just cause. In most companies an employee hand book exsists with rules regarding conduct for termination. I am co-owner of a mid size company and our employment lawyer is always telling our staff that an at will employee has rights and before termination their must be a track record of violations and just not to fire someone for things like being overweight. If you think you can do this kind of thing you will find yourself in court very, very fast.
