Deadbeat doesn't pay child support - I want FULL custody! In need of his recent court records, too.

my ex left the state we were divorced in several years ago.  within the first year of being gone he quit making child support payments.  He was previously married, so I knew he had a history of avoiding his obligations.

not receiving money from him consistently allowed my stubborn streak to kick in (I can do it myself!), and the headache of having less dollars in our pocket is significantly less than the headache involving money, contact, and visitation.  our state also determined that my earnings exceed the minimum to qualify the child for state health insurance, so I'm stuck paying full price for whatever service the child needs.  additionally, the child and i continue to live in substandard housing, making monthly contributions/rent to the pocket of the slumlord that manages the property.

over the previous two years, what income from the deadbeat that has arrived has been in the form of federal and state income tax returns and economic stimulus checks.  monthly statements from the collecting/reporting agency within my state declare over $20,000.00 remains owed by him.

court paperwork arrived from him earlier this year - he wants to modify the child support order, decreasing it by almost $200 each month.  his ability to provide financially is relative to his trade and training - he can and has earned more than $100,000 yearly.  the fact that he is not in the same professional industry now relates significantly to his inability to make good decisions (nailed using drugs!), and has created for him a unique place as a 'Ward of the State' he lives in.  i also was told that drug court in his state took precedence over any other financial obligations - in what world is this accurate?

last night i was online, and shelled out cash from my bank for one of those online criminal records reports, since i know all pertinent data - name, dob, ssn, etc.  with my heart in a frenzy, and the child banished to the bedroom for my right to search privacy, i clicked the links, and upon printing out copies of what there was, i was disgusted to note nothing newer than five years, and nothing on him from the state he's in!  court documents in my state show as public record - i can search for any court docs here online, but can't see what's in his state - are court records for-purchase items because i'm across state lines?

i need his criminal records from his current state of residence - i wish to ask the courts here to deny his request to modify child support. i also want to submit my own request to modify, showing significant change of circumstances in that i have provided sole support for in excess of 5 years, that with the distance between parental residences (out of state mentioned above) reduces feasibility that either parent can follow the custody arrangement as previously assigned by the court that maintains jurisdiction, and that his drug usage and abuse constitute reasonable grounds to award legal and physical custody to me, with supervised visitation at my discretion.

an attorney is out of the question - i have had to go months or years without insurance (or maintenance) on my vehicle (gasp!) so i could continue to afford small things like groceries, clothes, or laundry money.

i would appreciate anyone's help. i'll communicate with you, via email, if you'll post your address in the comments.  i have no idea if he or any of his friends go anywhere near Shine's website, so i'm cautious about using names or getting too specific.

    HI there, I used to work with the superior court clerks office in my state, a starting point would be to obtain copies of any and all legal documents filed with the court, these papers are generally public records and you can request those from the clerks office by writing them a letter and explaining your intentions and requests and ask what procedures need to be followed or met. Keep your story basic and simple and ask that the clerk of the court respond to you either by mail or a phone contact number and what kind of time frame are you looking at. A lot of people get intimidated by the court process which really isn't necessary. If your willing to do some of the footwork involved and abide by what the court asks of you they are often more than willing to offer you help in any way they can. if you like my e-mail is lupethe3rd@yahoo.com and we can talk more about this and discuss what your options really are.

    And if the records in that state are closed, as I have just discovered, then what recourse remains open to me?

    He's been in DRUG court, for Pete's sake!, and I copied this text from their FAQ page:

    There are three basic kinds of drug courts: adult criminal, dependency, and juvenile.

    1) Adult criminal drug courts focus upon individual adult offenders charged with a felony drug crime.

    2) Dependency drug courts hear cases where the state has alleged abuse or neglect on the part of the parent. These drug courts acknowledge that neglect and abuse may be a product of drug addiction. Subsequently, teams within this court hold parents accountable for their behavior by monitoring their treatment and encourage a focus on recovery so the family may be reunited.

    3) Juvenile drug courts are aimed specifically at first time or second time juvenile offenders. Requirements of juvenile drug court include 60 hours of community service, written essays on the dangers of drug use, and on-going court supervision.

    Though restrictions may vary by location and program, adult felony drug court is generally available to:

    Certain non-violent offenders charged with a felony drug crime. These crimes include forged prescriptions, possession with intent, and felony possession of a controlled substance.

    Offenders must be in the country legally.

    His behavior puts him into the individual adult offender category. What his residential state is COMPLETELY MISSING is that there potentially remains an ISSUE OF NEGLECT REGARDING THE CHILD, which MAY BE a product of drug addiction.

    ask the courts to have him relinquish his parental rights, thereby, no visitations,no child support, no headaches.
