Mom Refuses C-Section, Baby Taken Away

Wow, we just can't believe this.

A woman in New Jersey refused to consent to a C-section during labor in the event that her baby was in distress. She ended up giving birth vaginally without incident. The baby was in good medical condition.

However, her baby was taken away from her and her parental rights were terminated because she "abused and neglected her child" by refusing the C-section and behaving "erratically" while in labor.

How is this legal?

A New Jersey appellate court has upheld the shocking ruling, and custody has been given to the child's foster parents.

The court's decision cites hospital records that describe the mother, V.M., as "combative," "uncooperative," "erratic," "noncompliant," "irrational" and "inappropriate." That's how we acted during labor, too ... but our babies weren't taken away, thank God.

The court opinion also focuses on the fact that the mother had been in psychiatric care for twelve years prior to the birth. But, as the Huffington Post points out, her psychiatric state would never have been questioned if the mother had not refused invasive abdominal surgery -- which was entirely within her rights.

    Way to go New Jersey Court System (insert an insane amount of sarcasm here). Are you kidding me with this? How is this not national news displayed on every news website? WTF?!

    I have to admit, the court system really does suck. They allowed my oldest daughters father walk away with child molestation. Then when my child custody with my youngest daughter went down (and still is) they tried to slapped me with (which is all false accusations) child abuse, hiring a hit man, drug dealer, drug usage, sleeping with a minor. I mean the list goes on and on. My baby's father (that is an alcoholic) even had people testify in court stating that all this was true. And not one of their stories matched up. It was clear as day they ALL were liars. Yet, the court system is treating me as if Im the parent that needs help. the court system is messed up!

    That is sick. Its her choice if she wants to have the baby vaginally. Of course she was accting weird she was in labor!!!!!! And if she doesnt want a c-section they need to suck it up and deal with it. That is so disgusting that they would take the child away.That is sick this just reinforces that im NOT going to a hospital to have my kids i'll get a midwife.

    This is disgusting. How dare they say because she doesn't have a c-section shes abusing her child. That is such bull what about abortion? It's not abuse to abort your child but it is to refuse a c-section. How dare they. That just confirms that I'm having my babies with a midwife and not a doctor. My sisters midwife is awesome and would never try to force a woman to do something like that against her will. They said the baby was perfectly fine maybe the mom could feel that! Some people just know. I get so tired of doctors who think that they know more about your body than you do. Your the one in it NOT them it doesnt matter how much schooling they've had they don't know everything.

    While I agree with you on the post, I wouldn't cite the Huffington Post as a source in the future. Try to go for a source with a more neutral approach to what they write.

    This is why you have to be careful about where you give birth. If you don't want unnecessary medical intervention you've got to chose a hospital that supports that approach. I was in labor for 30 hours after my water broke and fortunately no one did anything other than encourage me to push!

    This story is really horrifying. After reading some of the court documents and the Huffington Post article (which was extremely well written, btw), there was absolutely no reason for this woman to have to sign consent consent for a C-section. Her child was born healthy, and both mother and baby were fine.

    I can't imagine the horror this woman must have suffered while she was in labor at the hands of the people who were supposed to be caring for her and her child, only to have them deliver her child into the hands of DYSF who in this case, clearly abused their power.

    DYSF is supposed to protect children and families. Their goal, and this is nation wide, is to PRESERVE THE FAMILY. There was absolutely no reason at all to dissolve this family.

    Given the amount of time, energy, and money that has been wasted on this case, they could have been out saving 20 other children who really needed their help and intervention instead of stealing a child from parents who loved and wanted it.

    This family, including this child, will never recover from what's been done to them.

    It looks like the hospital was just fishing fora reason to keep the patient from keeping the baby. They saw her chart, they had to know she has been under psychiatric help and saw her unfit. thats just awful.

    Impeach the judge! /Sue the hospital! Voters that vote for the judge who agreed with this decision really need to take a second look at him. This is a textbook example of a travesty of justice.
