Vaccinated without consent: a mom's H1N1 story

One CafeMom does not vaccinate her children against the seasonal flu, nor did she want her little girl immunized against H1N1. She just doesn't believe the illness is as bad as the media is making out to warrant it.

And yet, the school vaccinated her daughter without her consent. There have been stories of this happening other places, but this is the first I've heard involving a CafeMom.

This mom is sharing her experience her to let other moms know that while it may not be common, mistakes are being made:

How It Happened

On October 21, my 5 year old daughter's school distributed information about the vaccine along with a permission slip. It asked whether I consent to the H1N1 vaccine and I circled no. I returned the slip to the school a few days later. On a Monday, I got a slip of paper informing parents that vaccines would be given last Thursday. Children with forms that were not turned in would not get the vaccine, the letter said.

On that Thursday morning I told my daughter, Paige, that she won't be getting the vaccine, and that if they tried to give it to her, to tell them her mommy said no. When she got off the bus, I asked if any of her friends had received it. That's when she told me that she got it.

The Effects

They gave her the nasal mist. She and other students thought it was water being shot into their nose. She told me she'd explained to a teacher that she was not supposed to get the shot, but they didn't listen to her. She said it burned her nose and tasted bad. I tried calling the school and no one answered. I got there too late, nobody was there.

The Fallout

Last Friday I took her to school and confirmed with the principal that she did in fact get the shot. I asked who was responsible for looking at the forms and he said many people. I asked for a copy of the permission slip. They said the health department had it and would send me a copy. The school nurse was not there, so I did not talk to her. The health department called me back later and apologized, saying the vaccine was safe. If she has any reactions, I'm to take her to the doctor.

Taking Action

My husband called a couple of lawyers today, but we were not able to get a hold of anyone. I want people to know this is happening. I used to think parents were being paranoid about this vax, but not any more.

    Are you kidding me? My son got H1N1 and nearly DIED!!! His fever topped out at 107.6, and he went into convulsions. I truly do not understand why parents would not want to protect their children from this horrible illness. BTW... he gave it to me. We both are also asthmatic and developed bacterial pneumonia afterwards. We've both had sesonal flu shots, for us it is a must due to having asthma and the complications that come along with it.

    I would be LIVID if this happened to me and my child. The seasonal flu vaccine is ineffective, there are MANY studies that have PROVEN that. The H1N1 shot has many toxic preservatives, which may negatively affect your child.

    I would sue the living crap put of the school district for that one. This story is truly scary.

    Seasonal flu shots are not ineffective. But they only cover those strains of influenza that are in the shot. If a different strain is going around and wasn't covered by the shot, you may get sick. In my area of CA people are lining up in droves to receive the H1N1 vaccination. My child has asthma and I was stressed out to the max until he was able to finally get the H1N1 vaccination because there was an outbreak of it at his school (but the school did not shut down).

The schools are in bad enough shape as it is without over stressed parents like you suing them. What would be more productive to you and your child is to have a legal document written up stating that NO medical intervention, be it vaccination, bandage on a cut can be preformed on you child on school grounds without you or your husband being there. That way your child will never get vaccinated again against your wishes.

    I don't understand why a parent would not vaccinate their kid, woul dmuch rather take the chance at the very low percent who have a reactiont hen have my hcild get sick. I waited at her school for almost 2 hours in line for the vaccine. But the fact that she did not want her daughter to and they did anyway would really piss me off. That is not acceptable to go against a parents wishes.

    There are a lot more articles I could post about the studies that are coming out about the flu shots ineffectiveness. Research it for yourselves.

    Slam, I understand the point you made. The flu vax is a crap shoot, and I'll take the chance with the viruses over the crap, including mercury (which is still in most flu shots), that's being injected. I don't have time to cover all the info I've gathered on this subject over the last few years, so it's hard to get into it on these blogs. All I can say is, research it for yourselves, people, please.

    Kids shouldn't be getting vaccinated at school anyway. Has everyone gone insane, or are there just so many stupid, uninformed people around that they are so easily duped? That's the real question here.

    Hello! Ask anyone in the healthcare industry and they will tell you the vaccine and the nasal spray are unsafe! The testing was extremely limited! The nasal spray is an active virus! Shame on everyone for commenting her lack of permission for this! Swine flu has broken out in the US on several other occasions. This is just another strain of it. All flu can be deadly if underlying health conditions exist, even unbeknownst to the individual or family member, or left untreated.

    They shouldn't have done it without your permission, but I wish you would have reconsidered your stance on the vaccine. As someone who contracted swine flu, I can tell you that it was miserable. I got it more than two weeks ago and I'm still not 100%. Children have died from it, as have adults.

    While I don't think you should sue them, definitely make your point with the principal and perhaps the school board.

    I think it's terrible that they would do this without your consent. It is your decision as a parent to decide what medical treatments are given to your child. I find it even more ridiculous because there is a shortage of this vaccine (at least in my area) for the people who want it!! The school is about the only place my kids can get the shot, although this doesn't help my youngest who isn't in school, and we have been told we won't have the choice between the shot and the spray. If this had been doled out by doctors, instead of schools and clinics where they don't know you and spend 5 seconds with you, things like this would not be a problem. Your pediatrician would not have done this without your consent, chances are he or she knows you and you trust them.

    Along the lines of it being ineffective, I've heard if you've already been exposed to the virus the vaccine won't benefit you. And that there is a 2 week window between when you get the vaccine and when it is said to protect you. There are just way too many unknowns and lack of testing with it. I am not a fan of vaccines but can understand if people with other health conditions such as asthma might get it as a precaution.
