The Latest Prenup Trend: A Social Media Clause

- Roughly 80% of divorce attorneys surveyed say that social media behavior is increasingly an issue during divorce proceedings. But such behavior can also be an issue while a couple is still married, leading to this new trend reported by ABC News: social media clauses popping up in prenups.

It seems some people have issues with partners who over-share when they'd rather keep certain things offline. In anticipation of such arguments, one attorney says social media clauses have started popping up in prenups with greater regularity in the past two months.

Typical clauses put restrictions on posting embarrassing or compromising photos or stories that might harm the future spouse's rep. And the penalty, my dear betrothed? Cash, of course. For a New Yorker making less than $5 million, the fine tends to be $50,000 per episode of unruly social media behavior. That's right, one bad tweet could cost a spouse some serious green.
